Le juge national, dans un litige en matière administrative, ayant pour objet le contrôle juridictionnel d’une décision prise par l’autorité administrative nationale sur la base d’un recours de la personne privée intéressée, est-il tenu d’examiner la question de savoir si les règles de l’État membre indiquées à titre de fondement de la décision administrative sont contraires à une disposition de droit de l’Union ayant un effet direct et par ailleurs pertinente dans l’affaire en cause?
In administrative-law proceedings the object of which is judicial review, in the context of an action brought by the individual concerned, of a decision adopted by an administrative authority of the Member State, is the national court obliged to consider whether the provisions of national law on which the administrative decision is founded are contrary to any provision of EU law which is directly applicable and which is also relevant in the case concerned?
