A decision of this kind would not be analogous to a final judgment unless it were stated, as in Article 57 of the Directive, that it is an administrative decision ‘having final and binding effect in accordance with the legal provisions of the administrative authority of the Member State or of the Union that took the decision’.
Une telle décision ne saurait s'apparenter à un jugement définitif, sauf à préciser, à l'instar de l'article 57 de la directive, qu'il s'agit d'une décision administrative«ayant un effet contraignant, conformément aux dispositions légales applicables à l'autorité administrative de l'État membre ou de l'Union ayant pris la décision».
