84 The Court of First Instance was entitled in law to examine, in paragraphs 50 to 53 of the judgment under appeal, the different elements of the shape represented by the mark applied for and, subsequently, in paragraphs 53 and 54 of that judgment, to analyse the overall impression, in order to assess whether or not the mark is devoid of distinctive character.
C’est à bon droit que le Tribunal a procédé, aux points 50 à 53 de l’arrêt attaqué, à un examen des différents éléments composant la forme représentée par la marque demandée et, ensuite, aux points 53 et 54 de cet arrêt, à une analyse de son impression d’ensemble, afin d’apprécier si cette marque est dépourvue ou non de caractère distinctif.
