That is the case of a decision of the administration establishing that the name of a member of the temporary staff has not been included on the reserve list of a specific open competition and implementing the termination clause in his contract, which entails the termination of the contract if a given event should occur, namely the drawing-up of the reserve list of the competition referred to in that clause, the date of which was necessarily uncertain at the time when the contract was made.
Tel est le cas d’une décision de l’administration constatant la non-inscription du nom d’un agent temporaire sur la liste de réserve d’un concours général donné et mettant en œuvre la clause de résiliation contenue dans le contrat de celui-ci, clause entraînant la résiliation de ce contrat en cas de survenance d’un événement déterminé, à savoir l’établissement de la liste de réserve du concours visé par ladite clause, dont la date était nécessairement incertaine au moment de la conclusion de celle-ci.
