According to the case-law of the Court of Justice (48), ‘as regards the assessment of the condition of selectivity, which is a constituent factor in the concept of State aid, it is clear from settled case-law that Article 87(1) EC requires assessment of whether, under a particular statutory scheme, a State measure is such as to “favour certain undertakings or the production of certain goods” in comparison with other undertakings which are in a legal and factual situation that is comparable in the light of the objective pursued by the measure in question’ (49).
Conformément à la jurisprudence de la Cour de justice (48), «[e]n ce qui concerne l’appréciation de la condition de sélectivité, qui est constitutive de la notion d’aide d’État, il résulte d’une jurisprudence constante que l’article 87, paragraphe 1, CE impose de déterminer si, dans le cadre d’un régime juridique donné, une mesure nationale est de nature à favoriser “certaines entreprises ou certaines productions” par rapport à d’autres, qui se trouveraient, au regard de l’objectif poursuivi par ledit régime, dans une situation factuelle et juridique comparable» (49).
