11 (1) Dans une action en violation à l’égard d’un circuit intégré dans lequel est incorporée une topographie enregistrée ou une partie importante de celle-ci et qui est exploité commercialement au Canada par le propriétaire de la topographie ou avec son consentement, le seul recours ouvert au demandeur parmi ceux qui sont mentionnés à l’article 9 est l’injonction dans le cas où le défendeur démontre qu’au moment de la violation il ne savait pas et n’avait aucun motif raisonnable de soupçonner que la topographie était enregistrée.
