With regard to cross-compliance obligations, apart from grading administrative penalties in view of the principle of proportionality, it should be provided that starting from a certain moment, repeated infringements of the same cross-compliance obligation should, after a prior warning to the farmer, be treated as an intentional non-compliance.
En ce qui concerne les obligations liées à la conditionnalité, outre la pondération des sanctions administratives en fonction du principe de proportionnalité, il convient de prévoir qu’à partir d’un certain moment, des infractions répétées à la même obligation en matière de conditionnalité soient traitées, après une mise en garde préalable de l’agriculteur, comme un cas de non-conformité intentionnelle.
