WHEREAS without prejudice to the provisions of the Treaty on the Functioning of the European Union (hereinafter ‘TFEU’) and the Treaty establishing the European Atomic Energy Community (hereinafter ‘Euratom Treaty’), this Agreement and any activities entered into under it will in no way affect the powers vested in the Member States of the Union to undertake bilateral activities with Switzerland in the fields of science, technology, research and development, and to conclude, where appropriate, agreements to that end,
CONSIDÉRANT que, sans préjudice des dispositions du traité sur le fonctionnement de l'Union européenne (TFUE) et du traité instituant la Communauté européenne de l'énergie atomique (ci-après le «traité Euratom»), le présent Accord et toutes les activités menées au titre de celui-ci n'affecteront en aucune manière le pouvoir des États membres de l'Union d'entreprendre des activités bilatérales avec la Suisse dans les domaines de la science, de la technologie ainsi que de la recherche et du développement, et de conclure, le cas échéant, des accords à cet effet,
