In a Joint Declaration, [20] the Member States stated that they were ready to examine the possibility of conferring jurisdiction in certain matters on the Court of Justice, and the Convention has been supplemented by two Protocols conferring jurisdiction on the Court of Justice to interpret the Convention. But they are not yet in force.

A first group of stakeholders advocate a new rule giving jurisdiction in mass claim situations to the court where the majority of parties who claim to have been injured are domiciled and/or an extension of the jurisdiction for consumer contracts to representative entities bringing a collective claim.

The Court recalls that it is for the national court hearing the case to examine whether the parties have in fact agreed to the jurisdiction clause, because the verification as to whether the parties concerned have really consented is one of the objectives pursued by the regulation.

The Oberlandesgericht wishes to know whether that rule also applies where the Brussels I Regulation itself attributes exclusive jurisdiction to the court second seised.

The exclusive jurisdiction in matters relating to immovable property attributed by the Brussels I Regulation to the courts of a Member State is not affected by the fact that the court of another Member State was first seised

Therefore, while borders themselves are not an expressly assigned head of power in the Constitution Act, 1867, either Parliament now has jurisdiction over border crossings under the combined effect of paragraph 92(10)(a) and subsection 91(29), or Parliament may obtain jurisdiction over border crossings through a declaration or declarations made under s. 92(10)(c).

In the second part of the article, to which I would give the title ``federal jurisdiction'', we can read the following: ``In 1940 when the provinces consented to having this social insurance scheme placed under federal jurisdiction, as an exception, the constitutional amendment was to be precisely worded so as to turn over to the federal level only the creation and administration of an unemployment insurance plan''.
