In today’s judgment, the Court of Justice considers that it is clear from EU law that the jurisdiction of the court first seised is established (subject to the exclusive jurisdiction of the court second seised), if that court has not declined jurisdiction of its own motion and none of the parties has contested its jurisdiction prior or up to the time of the defence on the substance.
