3. Lorsque les marchandises ont été transportées en pontée contrairement aux dispositions du paragraphe 1 du présent article ou lorsque le transporteur ne peut pas, en vertu du paragraphe 2 du présent article, invoquer un accord pour le transport en pontée, il est responsable, nonobstant les dispositions du paragraphe 1 de l’article 5, des pertes ou dommages subis par les marchandises ainsi que du retard à la livraison qui résultent uniquement du transport en pontée, et l’étendue de sa responsabilité est déterminée conformément aux dispositions de l’article 6 ou de l’article 8 de la présente Convention, selon le cas.
