TRADUCTIONS EN CONTEXTE
There is now some useful case law dealing with these issues - notably C-72/95 the Dutch Dykes case, C-431/92 the Grosskrotzenburg case, C-392/96 Commission v Ireland and C-435/97 World Wildlife Fund and Others v Autonome Sektion Provinz Bozen and Others (the Bozen case).

On dispose désormais d'une jurisprudence utile à ce propos, notamment depuis les affaires C-72/95 (« digues hollandaises »), C-431/92 (Grosskrotzenburg), C-392/96 (Commission contre Irlande) et C-435/97 (World Wildlife Fund e.a. contre Autonome Provinz Bozen e.a (Bozen).

Just as case law (the body of judge-made law) is an important part of the common-law system, rulings (the body of Speaker-made parliamentary law) are an important part of our parliamentary system.

Ms Reierson made a statement, answered questions and tabled a list of Nova Scotia case law dealing with child support guidelines decisions entitled, " Memorandum dated February 23, 1998 from Lara to R/S Lawyers and Nancy regarding Case Law Summary Post-Secondary Education Costs" , being Exhibit No. 5900-1.36/S2-SS-1-8-4 " 2" and a case law summary dealing with post-secondary education costs entitled, " Appendix B, Additional Child Support Guidelines Decisions" , being Exhibit No. 5900-1.36/S2-SS-1-8-4 " 3" .

The Office of the Commissioner of Official Languages or another entity with the necessary funds could have this case law translated in order to ensure greater unity, primarily in the decisions in federal law and also in criminal law, and in order that Quebec case law might be of use elsewhere, as Canadian case law is in Quebec.

Thus, the Civil Service Tribunal disregarded, in the first place, the case-law according to which the statement of reasons for the decision rejecting a complaint is deemed to supplement the statement of reasons for the decision against which the complaint was directed (see, to that effect, Case T-562/93 Obst v Commission [1995] ECR-SC I-A-247 and II-737, paragraph 79, and Case T-71/96 Berlingieri Vinzek v Commission [1997] ECR-SC I-A-339 and II-921, paragraph 79), in the second place, the principle of legality, according to which the reasons for a decision may be based only on factors which predate or are contemporaneous with it, and, in ...[+++]

I don't have the case law to prove it, but I know what's in the case law.

According to settled case-law, for a trade mark to possess distinctive character for the purposes of Article 7(1)(b) of Regulation No 40/94 it must serve to identify the goods in respect of which registration is sought as originating from a particular undertaking, and thus to distinguish those goods from those of other undertakings (see, in particular, Joined Cases C-456/01 P and C-457/01 P Henkel v OHIM [2004] ECR I-5089, paragraph 34; Case C-136/02 P Mag Instrument v OHIM [2004] ECR I-9165, paragraph 29, and Case C-238/06 P Develey v OHIM [2007] ECR I-9375, paragraph 79).

The Court also stated that such an interest exists as long as the appeal may, if successful, procure an advantage to the party bringing it (see, Case C-277/01 P Parliament v Samper [2003] ECR I-3019, paragraph 28, and Case C-362/05 P Wunenburger v Commission [2007] ECR I-4333, paragraph 42, and order of 8 April 2008 in Case C-503/07 Saint-Gobain Glass Deutschland v Commission [2008] ECR I-2217, paragraph 48 and the case-law cited).

In that regard, the Civil Service Tribunal took the view that while the examiners marking the written tests, in contrast to the members of the selection board sitting in the oral phase, may admittedly not be known to the persons concerned, and are thereby protected from interference and pressures to which the judgment in Parliament v Innamorati, paragraph 16 above, refers, that circumstance does not objectively justify the existence of significant differences between the requirements concerning the statement of reasons in the case of failure in the written phase, as those requirements are formulated in the case-law cited in paragraph 39 ...[+++]

We have a lot of case law and common law in this country that when there is an absence of statute law, Parliament can fill that void by passing a statute and that it would not necessarily be unconstitutional if it differs from what the court may envisage in that absence. Parliament could just as easily pass a statute law respecting the traditional definition of marriage and put forward that compromised position of civil unions without it being unconstitutional.
