TRADUCTIONS EN CONTEXTE
Factors that a court may consider in deciding whether to decline jurisdiction over a proceeding include the location of the majority of the parties; the location of key witnesses and evidence; contractual provisions that specify applicable law or accord jurisdiction; the avoidance of a multiplicity of proceedings; the applicable law and its weight in comparison to the factual questions to be decided; geographical factors suggesting the natural forum; and whether declining jurisdiction would deprive the plaintiff of a legitimate juridical advantage available in the domestic court (see Muscutt v. Courcelles (2002), 213 D.L.R (4) 577 ...[+++]

In today’s judgment, the Court of Justice considers that it is clear from EU law that the jurisdiction of the court first seised is established (subject to the exclusive jurisdiction of the court second seised), if that court has not declined jurisdiction of its own motion and none of the parties has contested its jurisdiction prior or up to the time of the defence on the substance.

Finally, the Court of Justice states that, in the present case, its interpretation is unlikely to give rise to a negative conflict of jurisdiction (in which case the parties would be obliged to bring fresh proceedings if the court first seised were to decline jurisdiction), since the jurisdiction of the English court can no longer be contested.

The rapporteur proposes leaving the graduated rules on jurisdiction proposed by the Commission with regard to the varying arrangements between the Member States on registered partnerships unchanged. For Member States which do not recognise registered partnerships, the proposal provides that courts in such States may decline jurisdiction. However, if they do not, courts may not generally invoke public policy as a reason not to allow foreign law on partnerships to be applied.
