The Appeal Court, Trento, before which he appealed, asks the Court of Justice whether the Directive on the return of illegally staying third-country nationals (‘the Directive on return’) 1 precludes national rules which provide for a prison sentence to be imposed on an illegally staying foreign national on the sole ground that he remains, without valid grounds, on the national territory, contrary to an order to leave that territory within a given period.
La Cour d'appel de Trento, devant laquelle il a interjeté appel, demande à la Cour de justice si la directive sur le retour des ressortissants des pays tiers en séjour irrégulier (« directive retour ») s’oppose à une réglementation nationale qui prévoit l'infliction d'une peine d’emprisonnement à un étranger en séjour irrégulier pour la seule raison que celui-ci demeure, en violation d’un ordre de quitter le territoire national dans un délai déterminé, sur ce territoire sans motif justifié.
