The Commission felt that the decision taken by the Vlaams Commissariaat voor de media obliging channel VT4, which comes under British jurisdiction, to submit a request for authorisation to it, infringed - on the one hand - the Directive's rules on legal jurisdiction, which state that only the State of establishment of the broadcaster has the powers to control it, and - on the other - Article 10 of the EC Treaty.
Dans le cas d'espèce, la Commission a considéré que la décision du Vlaams Commissariaat voor de media obligeant la chaîne VT4, sous compétence britannique, à introduire une demande d'autorisation auprès de lui, constituait une infraction, d'une part, aux règles de rattachement juridique de la directive, qui prévoient que seul l'État d'établissement du radiodiffuseur est compétent pour le contrôler, et, d'autre part, à l'article 10 du traité CE.
