Le Groupement Européen de Droit international privé suggère d'insérer à l'article 4 3 une disposition relative aux locations de vacances inspirée de celle figurant à l'article 22 1 du Règlement "Bruxelles I" et qui pourrait être la suivante : "Toutefois, le bail d'immeuble conclu en vue d'un usage personnel temporaire pour une période maximale de six mois consécutifs est régi par la loi de l'Etat dans lequel le propriétaire a sa résidence habituelle ou son établissement, si le locataire est une personne physique et s'il a sa résidence habituelle dans ce même Etat".


In addition, this solution may be incompatible with the Brussels I Regulation, Article 22 of which contains - unlike the Brussels Convention of 1968 - a specific rule on "tenancies of immovable property concluded for temporary private use for a maximum period of six consecutive months".
