Following an appeal, the Corte di Appello di Genova referred to the Court of Justice certain questions amounting in substance to the following : a) whether, for the purpose of calculating the VAT payable in Italy, account should not have been taken of the residual VAT which was paid in Germany and was still incorporated in the value of the goods at the time of importation, b) whether Community law prohibits a Member State from treating failure to pay VAT on imorts as smuggling when failure to pay VAT on domestic transactions is subject to much less serere penalties.
En appel, la Corte d'Appello de Gênes a soumis à la Cour de Luxembourg essentiellement deux questions: a) si, pour le calcul de la TVA due en Italie il ne fallait pas tenir compte du résidu de TVA payée en Allemagne et encore englobée dans la valeur de la marchandise lors de l'importation; b) si le droit communautaire s'oppose à ce qu'un Etat membre assimile l'évasion de la TVA à l'importation à la contrebande, alors que l'évasion de la TVA à l'intérieur expose à des sanctions beaucoup moins graves.
