In those circumstances, the decision of the institution rejecting the request of the member of the temporary staff concerned that the termination clause in his contract be considered void or, in any case, that it not be applied to him with respect to a specific competition, so that he is not required to participate in that competition, is an act adversely affecting that person within the meaning of Article 90(2) of the Staff Regulations.
Dans ces conditions, la décision de l’institution portant rejet de la demande de l’agent temporaire concerné tendant à ce que la clause de résiliation contenue dans son contrat soit considérée comme nulle ou, en tout cas, qu’elle ne lui soit pas applicable en ce qui concerne un concours donné de telle sorte qu’il ne soit pas tenu de participer à ce concours, est un acte faisant grief au sens de l’article 90, paragraphe 2, du statut.
