En ce qui concerne le deuxième moyen, tiré de la violation de l’article 7, paragraphe 1, sous b), du règlement nº 40/94, le Tribunal a notamment relevé, aux points 75 et 74 respectivement des arrêts T‑109/08 et T‑110/08, que, s’agissant de l’appréciation proprement dite du caractère distinctif des marques dont l’enregistrement était demandé, la chambre de recours de l’OHMI avait estimé que la couleur et le matage du verre de la bouteille ne pouvaient pas «fonctionner comme marque» pour le vin mousseux.
As regards the second plea, alleging infringement of Article 7(1)(b) of Regulation No 40/94, the Court noted in particular, at paragraphs 75 and 74 of the judgments in T-109/08 and T-110/08 respectively, that, in respect of the actual assessment of the distinctive character of the marks for which registration was sought, the Board of Appeal was of the opinion that the colour and matting of the glass of the bottle could not ‘function as a trade mark’ for sparkling wine.
