En application de l’article 7 modifié, l’obtenteur ou son représentant légal peut demander un certificat d’obtention s’il est citoyen ou résident du Canada, d’un État de l’Union ou d’un pays signataire 19. Si ni l’obtenteur ni son représentant légal n’est une personne physique, la personne morale peut demander un certificat d’obtention si elle a un établissement au Canada, dans un État de l’Union ou dans un pays signataire.
Under amended section 7 of the Plant Breeders’ Rights Act, a plant breeder or a plant breeder’s legal representative may apply for a grant of plant breeders’ rights if he or she is a citizen or resident of Canada, a country of the Union or an agreement country.19 In the case where the breeder or legal representative is not an individual, that person may apply for a grant of plant breeders’ rights if it has an establishment in Canada, a country of the Union or an agreement country.
