44. Notes the intention to revise the European Works Council Directive (94/45/EC); calls on the Commission and Council to take due account of Parliament's resolution of 17 January 2007 stating the need to protect workers' rights in restructuring processes affecting industrial undertakings, the need to guarantee full access to information and the possibility of decisive intervention throughout the process, including the right to vote, and the need to define the criteria for the compensation that would be owed to workers should the undertaking fail to comply with its contractual obligations;

Insists on protection for the rights of female and male workers in restructuring processes affecting industrial undertakings, on the need to guarantee their structures, in particular the European Works Councils, full access to information and the possibility of decisive intervention throughout the process, including the right to vote, and on the need to define the criteria for the compensation that would be owed to workers in the event of the undertaking failing to comply with its contractual obligations;

Calls for the rights of workers to be protected when manufacturing companies are restructured and hence for the availability of information to be fully guaranteed, for workers’ representative bodies, especially European Works Councils, to wield decisive influence throughout the process, including the right of veto, and for criteria to be laid down to determine what compensation should be paid to workers if a company fails to honour its commitments;

In January of this year, in response to requests from its unions, Devco's management agreed to establish a joint planning committee which is following the process as outlined in the Canada Labour Code to resolve issues related to the existing human resources package.
