Au cours de sa réunion du 31 mars 2009, après avoir noté que l'échec manifeste de la Commission à obtenir d'un groupe de personnalités désignées par le Comité scientifique et technique un nouvel avis sur les normes de base avant qu'elle ne présente une nouvelle proposition, constituerait une violation d'une règle essentielle de procédure, violation qui, conformément à l'article 230, deuxième alinéa, du traité CE, constituerait un motif de révision de l'acte ainsi adopté, a décidé, par 13 voix contre 6 et aucune abstention, de recommander que la base juridique appropriée soit: les articles 31 et 32 du traité EURATOM.
At its meeting of 31 March 2009, while noting that the Commission’s apparent failure to obtain a new opinion on the basic standards from a group of persons appointed by the Scientific and Technical Committee before presenting its new proposal would constitute an infringement of an essential procedural requirement which, pursuant to Article 230 (second subparagraph) EC, constitutes a ground of review of the act thus adopted, the Committee on Legal Affairs accordingly decided, by 13 votes in favour, 6 votes against and no abstentions, to recommend that the appropriate legal basis is Articles 31 and 32 of the EURATOM Treaty.
