Selon l’avocat général, l’interdiction des discriminations d’ordre fiscal touchant les produits, édictée par le droit de l’Union, en vertu de laquelle un État membre ne peut frapper, directement ou indirectement les produits des autres États membres, d'impositions intérieures supérieures à celles qui frappent les produits nationaux similaires, ne s’oppose pas à l’impôt spécial hongrois.
According to the Advocate General, in addition, the prohibition under EU law of tax discrimination in respect of products, according to which no Member State may impose, directly or indirectly, on the products of other Member States any internal taxation of any kind in excess of that imposed on similar domestic products, does not preclude the Hungarian special tax.
