By way of derogation from the prohibitions provided for in points (a) and (c) of Article 2, the Member States concerned may authorise the dispatch for immediate slaughter of live pigs from the areas listed in Part III of the Annex to other areas in the territory of the same Member State or to areas listed in Part II or III of the Annex of another Member State in case there are logistic limitations in the slaughter capacity of the slaughterhouses approved by the competent authority in accordance with Article 12 located in the areas listed in Part III of the Annex, provided that:

AA. whereas the ban on the use of animal protein in animal feed was introduced following the BSE crisis so as to prevent any contamination with TSE; whereas this ban should only be lifted based on scientific facts and sufficient measures of precaution and control; whereas based on these conditions processed animal proteins from slaughter offal for the production of feed for monogastric animals (pork and poultry) should be considered, provided that the ingredients stem from meat which was approved for human consumption, and that the ban on intra-species recycling and forced cannibalism is fully implemented and controlled,

This ban is incompatible with, among other things, the provisions allowing the use of slaughter methods prescribed by religious rites.

No progress has been achieved in this area because the Hindu religion prohibits slaughtering of bovine animals and the Indians fear that the export of hides and skins would increase slaughtering of animals and take away the artificial subsidy for the Indian tanning industry that an export ban implies.
