(46) considérant que, le brevet ayant pour fonction de récompenser l'inventeur par l'octroi d'un droit exclusif, mais limité dans le temps, au titre de sa créativité, et d'encourager ainsi l'activité inventive, le titulaire du brevet doit avoir le droit d'interdire l'utilisation d'une matière autoreproductible brevetée dans des circonstances analogues à celles où l'utilisation de produits brevetés non autoreproductibles pourrait être interdite, c'est-à-dire la production du produit breveté lui-même;
(46) Whereas, in view of the fact that the function of a patent is to reward the inventor for his creative efforts by granting an exclusive but time-bound right, and thereby encourage inventive activities, the holder of the patent should be entitled to prohibit the use of patented self-reproducing material in situations analogous to those where it would be permitted to prohibit the use of patented, non-self-reproducing products, that is to say the production of the patented product itself;
