L'article 7 donne une liberté d'appréciation au Conseil aussi bien pour la constatation du risque clair de violation grave que pour la constatation de l'existence de la violation grave et persistante, statuant, selon le cas, sur la base d'une proposition soumise par le Parlement européen, un tiers des Etats membres ou la Commission.
Article 7 gives a discretionary power to the Council both to determine that there is a clear threat of a serious breach and to determine that there is a serious and persistent breach, acting as appropriate on the basis of a proposal by the European Parliament, one third of the Member States or the Commission.
