Whereas the ILO Maritime Labour Convention, 2006 (hereinafter referred to as the Convention) requires each Member to satisfy itself that the provisions of its laws and regulations respect, in the context of the Convention, the fundamental rights to freedom of association and the effective recognition of the right to collective bargaining, the elimination of all forms of forced or compulsory labour, the effective abolition of child labour and the elimination of discrimination in respect of employment and occupation.

Both prisons operating outside the law and the use of torture for the purposes of interrogation would constitute breaches of the European Union’s Charter of Fundamental Rights, of the Council of Europe’s Human Rights Convention and of the Convention against Torture ratified by all Member States of the European Union and by all candidates for accession to it.

Child trafficking[lv] must be tackled in the light of the EU Charter of Fundamental Rights that stresses the child's best interests as a primary consideration in all actions relating to children.[lvi] The Convention on the Rights of the Child of 1989 (CRC)[lvii] as the most important international child rights instrument includes provisions on child trafficking.[lviii] The Convention applies to every child under the age of 18 years, an approach which is shared by the Commission.

3. Calls on the Council and the Member States to work for the universal ratification of the main human rights instruments available to countries, in particular the International Convention on Civil and Political Rights, the International Covenant on Economic, Social and Cultural Rights, the Convention on the Elimination of All Forms of Discrimination against Women and the Optional Protocol thereto, the Convention on the Rights of the Child and the two Optional Protocols thereto on the involvement of children in armed conflict and on the sale of children, child prostitution and child pornography, the Convention on the Elimination of Racia ...[+++]l Discrimination and the Convention against Torture, and calls on all governments, as a matter of urgency, to ratify these conventions without reservation and to implement them;

12. Calls on the international community to examine the appropriate measures to be taken both vis-à-vis non-signatory states which persist in using anti-personnel landmines in an indiscriminate and irresponsible manner, and vis-à-vis countries which, despite having signed the Convention, continue to utilise anti-personnel landmines; believes that violations of the Convention and other elements of international humanitarian law should be appropriately sanctioned, but this should not be achieved by denying the benefit of vital mine and ordinance clearance work to the populations of countries affected;

[8] The relationship between Community law and the Human Rights Convention is a complex one Suffice it to say in this context that all Member States are signatories to the Convention and hence bound by its provisions.
