GAD is so far the only department with a detailed corruption risk assessment and has also forwarded a significant number of corruption signals to the prosecution.[62] To build upon these achievements and fulfil its potential, GAD should now expand their track record of cases in further areas of serious and complex corruption, including public procurement and investigations into corrupt links between police and organised crime.

Whether it takes the form of political corruption, corrupt activities committed by and with organised criminal groups, private-to-private corruption or so-called petty corruption, the abuse of power for private gain is not acceptable and can have serious impacts.

For example, the offence of bribery of domestic public officials is covered by a series of existing Criminal Code offences, including bribery of judges and members of the federal Parliament or a provincial legislature, section 119; bribery of police, court officers and anyone involved in the administration of the criminal law, section 120; bribery of government officials, section 121; bribery of municipal officials, section 123; and breach of trust, section 122.

Therefore further development and implementation of a comprehensive EU anti-corruption policy including criminal law measures, promotion of ethics and integrity in public administration and improved monitoring of national anti-corruption policies in the context of EU and international obligations and other standards is essential and also timely in order to effectively implement the UN Convention Against Corruption.[10] Fostering public sector transparency is one of the Commission’s strategic objectives 2005-2009 and a White Paper on a European Transparency Initiative will follow.

According to its summary, the bill amends the Corruption of Foreign Public Officials Act to increase the maximum sentence of imprisonment applicable to the offence of bribing a foreign public official; eliminate the facilitation payments exception to that offence; create a new offence relating to books and records and the bribing of a foreign public official or the hiding of that bribery; and establish nationality jurisdiction that would apply to all of the offences under the Act.
