En tout état de cause, on peut noter que le projet de charte actuellement soumis à l'approbation des trois institutions en vue de sa proclamation à Nice consacre, à son article 45, le droit de tout citoyen ou toute citoyenne de l'Union, "de circuler et de séjourner librement sur le territoire des États membres", et prévoit, au deuxième paragraphe de cet article, que "la liberté de circulation et de séjour peut être accordée, conformément au TCE, aux ressortissants des pays tiers résidant également sur le territoire d'un État membre".
