TRADUCTIONS EN CONTEXTE

Il convient de garder à l'esprit l’objectif de la directive, à savoir déterminer les conditions d’exercice du droit au regroupement familial et faciliter l’intégration des ressortissants de pays tiers qui remplissent les conditions dans l’État membre concerné[8]. La Commission aimerait en particulier inviter les États membres qui ont signalé des problèmes d’abus du droit au regroupement familial à les préciser et à les quantifier afin de pouvoir les aborder de façon plus ciblée à l’échelle européenne.

Une directive de l’Union définit les membres de la famille qui peuvent, dans le cadre du regroupement familial avec un ressortissant d’État tiers séjournant dans un État membre, bénéficier d’un permis de séjour. Afin d’assurer une meilleure intégration et d’éviter les mariages forcés, la directive prévoit que les États membres ont la faculté d’imposer, pour les conjoints souhaitant bénéficier du regroupement familial, un âge minimal qui ne peut toutefois excéder 21 ans. La directive ne précise cependant pas à quel moment le regroupant et son conjoint doivent avoir atteint cet âge.

With regard to spouses, in order to ensure better integration and to prevent forced marriages, Directive 2003/86/EC provides that Member States may impose a minimum age (no more than 21 years) for the purpose of family reunification. The directive does not, however, specify the point at which the sponsor and his or her spouse must have reached that minimum age limit.

The Court held, next, that the power of the Member States to defer family reunification for two or, as the case may be, three years permits them to make sure that family reunification will take place in favourable conditions, after the sponsor has been residing in the host State for a sufficiently long period for it to be assumed that the family members will settle down well and display a certain level of integration.
