L'article 90 du Traité prévoit que les Etats membres, en ce qui concerne les entreprises publiques et les entreprises auxquelles ils accordent des droits spéciaux ou exclusifs n'édictent ni ne maintiennent aucune mesure contraire aux règles du traité et notamment aux règles directement applicables relatives à la concurrence, à la libre circulation des biens et des services et au droit d'établissement.
Article 90 of the EEC Treaty requires in the case of public undertakings and undertakings to which Member States grant special or exclusive rights that Member States neither enact nor maintain in force any measure contrary to the rules of the EEC Treaty, including applicable rules on competition, free movement of goods and right of establishment.
