Eu égard à ces dispositions, les États membres et la Commission ne communiquent au public aucune information concernant un produit dangereux notifié par l'intermédiaire de l'application RAPEX si la divulgation de cette information enfreint le secret de l'instruction, qu'elle est préjudiciable aux activités de contrôle et d'enquête ou qu'elle viole le secret professionnel, sauf s'il s'agit d'informations concernant les caractéristiques de sécurité des produits que les circonstances imposent de divulguer dans l'intérêt de la protection de la santé et de la sécurité des consommateurs.
In the light of these provisions, Member States and the Commission should not disclose to the public any information about a dangerous product notified through the RAPEX application if such disclosure undermines the protection of court proceedings, monitoring and investigation activities or professional secrecy, except for information relating to the safety properties of products which must be made public if circumstances so require to protect the health and safety of consumers.
