Acting pursuant to Article 90(3) of the EEC Treaty, the Commission contacted the Portuguese Government, urging it to end this discrimination on the grounds of nationality by the national airline TAP. It emerged that Portugal had in the meantime adopted decrees (No 905/87 of 27 November, No 910/87 of 30 November and Nos 925B/87 and 925C/87 of 4 December 1987) whereby the reduced air fares would also be available for nationals of other Member States resident in the Azores and Madeira.
