Lorsqu’un projet d’aménagement hydraulique risque, selon ce qu’estime une bande ayant droit à des terres, de porter atteinte à ses droits de riverain reconnus en droit, celle-ci, le Canada ainsi que la Saskatchewan, le cas échéant, conviennent d’examiner conjointement ou, au besoin, de procéder conjointement à une évaluation des répercussions environnementales ou à d’autres études sur les effets, ou les effets possibles, de ce projet d’aménagement hydraulique, selon ce qu’exigent les lois applicables.
Where any Water Project may, in the opinion of an Entitlement Band, reasonably be expected in a discernible way to adversely affect an Entitlement Band’s common law riparian rights, the Entitlement Band and Canada and/or Saskatchewan, as the case may be, agree to jointly review or, if applicable, jointly conduct any environmental impact assessments or other studies concerning the effects, or possible effects, of any Water Project as may be statutorily required.
