2a . Member States shall allow insurance intermediaries or insurance undertakings when carrying out insurance mediation activities that consist only of executing customer orders, to provide those activities to their customers without the need to obtain the information or make the determination provided for in paragraph 2 where all the following conditions are met:

To be able to answer the question, we must look at the Community instruments governing the single market in insurance (notably the second and third non-life framework Directives). These provide that the supervisory authorities in a Member State may require a foreign insurer carrying on business in its territory to comply with its national rules as long as they are justified in the interest of the general good (Article 28 of the third non-life insurance Directive, Directive 92/49/EEC).

Pour répondre à cette question il faut rappeler que les textes communautaires (notamment les 2ème et 3ème Directives-cadre non vie) qui organisent le Marché unique de l'assurance prévoient que le contrôle d'un Etat membre peut imposer le respect de ses règles nationales à un assureur étranger qui opère sur son territoire pour autrui qu'elles soit justifiées pour des raisons d'intérêt général (Article 27 de la 3ème Directive assurance non vie 92/49/CEE).
