La Corte ritiene che una limitazione del diritto alla riduzione dell’imposta sul reddito, come quella prevista in diritto polacco, costituisce una restrizione alla libertà di circolare e di soggiornare sul territorio degli Stati membri che non è obiettivamente giustificata.
The Court is of the view that a limitation of the right to a reduction of income tax, such as that provided for under Polish law, constitutes a restriction on the freedom of movement and residence in the territory of the Member States which is not objectively justified.
