Nella sentenza T-129/00 il Tribunale statuiva che la commissione di ricorso dell’UAMI aveva a ragione concluso che il marchio tridimensionale del quale era chiesta la registrazione era privo di carattere distintivo nel senso di cui all’art. 7, n. 1, lett. b), del regolamento n. 40/94, e ciò per i seguenti motivi:
