Finally, the effects conferred by the European patent with unitary effect shall not extend to the use of the patented invention on board vessels, aircrafts or land vehicles of countries other than participating Member States, when such vessels, aircrafts or vehicles temporarily or accidentally enter the waters of participating Member States and to the use by a farmer of protected livestock for farming purposes, on condition that the breeding animals or other animal reproductive material was sold or otherwise commercialised to the farmer by the patent proprietor or with his consent.
Enfin, les effets conférés par le brevet européen à effet unitaire ne s’étendent pas à l’emploi de l’invention brevetée à bord d’appareils de locomotion maritime, aérienne ou terrestre de pays non participants, lorsque ces appareils pénètrent temporairement ou accidentellement dans les eaux des États membres participants, ni à l’utilisation par un agriculteur de bétail protégé à des fins agricoles, pour autant que les animaux d’élevage ou le matériel de reproduction animal aient été vendus à l’agriculteur ou commercialisés sous une autre forme par le titulaire du brevet ou avec son consentement.
