À l’argument avancé par CFF remettant en cause l’application de la jurisprudence Gröditzer en se référant au fait que l’apport en capital de l’État dans la SNCM a été lié à la vente de 75 % de sa participation, diminuant d’autant les perspectives de bénéfice en retour, les autorités françaises rappellent que le prix de cession négatif de 158 millions d’euros correspond bien à la cession de la totalité du capital de la SNCM, suivie d’un nouvel investissement par l’État à hauteur de 25 % bénéficiant d’un retour de [.] % par an.
In response to CFF’s argument calling into question the application of the Gröditzer case-law by referring to the fact that the capital contribution of the State in SNCM was linked to the sale of 75 % of its holding, reducing in proportion the prospects of profit in return, the French authorities note that the negative sale price of EUR 158 million does correspond to the sale of the entirety of SNCM’s capital, followed by a new investment by the State of 25 % giving a return of [.] % per year.
