In that context, a provision of the Framework Decision precludes judicial authorities from refusing to execute the European arrest warrant issued for the purposes of executing a sentence, in a situation where the person concerned failed to appear at trial, where, having been aware of the scheduled trial, that person gave a mandate to a legal counsellor to defend him and he was actually defended by that counsellor.
Dans ce contexte, une disposition de la décision-cadre empêche les autorités judiciaires de refuser d'exécuter le mandat d'arrêt délivré aux fins d'exécution d'une peine, dans une situation où l'intéressé n'a pas comparu en personne au procès, lorsque, ayant eu connaissance du procès prévu, il a donné mandat à un conseil juridique pour le défendre et qu’il a été effectivement défendu par ce dernier.
