same decision, even after having heard the person concerned, would amount to rendering nugatory the fund
amental right to be heard affirmed in Article 41(2)(a) of the Charter of Fundamental Rights of the European Union, since the very essence of that rig
ht implies that the person concerned should have the possibility of influencing the decision-makin
