5. Notwithstanding paragraphs 1 and 4, a biocidal product may be authorised when the conditions laid down in paragraph 1(b)(iii) and (iv) are not fully met, or may be authorised for making available on the market for use by the general public when the criteria referred to in paragraph 4(c) are met, where not authorising the biocidal product would result in disproportionate negative impacts for society when compared to the risks to human or animal health or to the environment arising from the use of the biocidal product under the conditions laid down in the authorisation.
5. Nonobstant les paragraphes 1 et 4, un produit biocide peut être autorisé lorsque les conditions établies au paragraphe 1, points b) iii) et iv) ne sont pas totalement remplies, ou peut être autorisé en vue d'une mise à disposition sur le marché pour utilisation par le grand public lorsque les critères visés au paragraphe 4, point c), sont remplis, si la non-autorisation du produit biocide devait avoir des conséquences négatives disproportionnées pour la société par rapport aux risques que son utilisation, dans les conditions fixées dans l'autorisation, représente pour la santé humaine ou animale ou pour l'environnement.
