Since the concept of 'public bodies' is not defined, it would appear to overlap with that of 'bodies governed by public law' (which fall within the subjective scope of the Directive, in accordance with a substantive concept of public administration), with the result that the Directive would allow for the possibility of bodies governed by public law having an entrepreneurial role and thus make it more difficult to define them (while strengthening what was previously, in the absence of corresponding legislation, a minority interpretation)
La notion d'"organismes publics" n'étant pas définie, elle semble se superposer à celle d'"organismes de droit public" (lesquels sont inclus dans le domaine d'application subjectif de la directive, conformément à une conception substantielle de l'administration publique); la directive admettrait ainsi – donnant raison à une interprétation jusqu'à présent minoritaire, faute d'équivalent réglementaire – que les organismes de droit public revêtent un caractère d'entreprise, rendant par là leur délimitation plus difficile.
