This Communication focuses on the 2013 marketing ban. However, the described implementation mechanisms and principles apply equally to the testing ban and the 2009 marketing ban.

A mandatory ban imposed under statute would require the person who sought the ban in the first place and the person who benefited from the ban making a joint application to a court to have the ban revoked.

The conventions to be respected would be those adopted by the WTO regarding the ban on child labour, the ban on forced labour, the ban on various forms of discrimination and the defence and promotion of the right to belong to a trade union and collective bargaining rights.
