Article 249 places it in a middling position in the Community legislative hierarchy, whereas Articles 202 and 269 give it the prestige it needs to climb effortlessly to the summit of that hierarchy, where it either lays down what the Treaty terms ‘requirements’ in respect of the exercise of implementing powers (‘comitology decision’), giving it the status of an organic act, or formalises the ‘provisions relating to the system of own resources’, which places it on an equal footing with an international treaty.
