In a normal situation the first nation would be obliged to buy out the third-party interest, but if a first nation doesn't desire to do so and the third party doesn't desire to do so—and the third party is clearly not obliged to sell out its interests—then the first nation will have a mechanism, a tool, to enable it to provide commercial certainty to the third-party interest holder that its interest will be respected once the lands have become reserve.
