An application for revision of a judgment may exceptionally be made to the Community Patent Court on discovery of a fact which is of such a nature as to be a decisive factor, and which, when the judgment was given, was unknown to the party claiming the revision, and only on the grounds of a fundamental procedural defect or of an act which was held, by a final court decision, to constitute a criminal offence.

Clause 8(2) of the revised Framework Agreement states that the implementation of the provisions of the Agreement shall not constitute valid grounds for reducing the general level of protection afforded to workers in the field covered by the Agreement.

The report condemns the fact that the unanimity of the States continues to apply to the Constitutions’ revision procedure, and continues to do so even in the future.

Constitutional revision is the exclusive competence of the Member States. The Commission may not interfere with the revision process of Article 24 of the Greek Constitution relating to the protection of the environment. However the Commission is following the matter with great interest and is confident that Article 24 if revised will not deviate from the sustainable development and integration principles enshrined in the EC Treaty. The Commission does not consider it necessary or appropriate to make recommendations to the Greek Government.
