It is submitted that the case of Pringle (2) upon which the General Court relied (3), decides that whereas the Commission and the ECB solely commit the ESM (4), nevertheless at inter alia (5) paragraph 164 of that case the court observed that the ‘tasks allocated to the Commission by the ESM Treaty enable it, as provided in 13(3) and 13(4) of that treaty, to ensure that the memoranda of understanding concluded by the ESM are consistent with EU law’ and at paragraph 174 that ‘under Article 13(3) of the ESM Treaty the MoU which is to be negotiated with the Member State requesting stability support must be fully consistent with EU law’.
Dans l’arrêt Pringle (2) sur lequel le Tribunal s’est fondé (3), bien que la Commission et la BCE n’engagent que le MES (4), la Cour a observé notamment au point 164 (5) que «les tâches attribuées à la Commission par le traité MES lui permettent, ainsi que le prévoit l’article 13, paragraphes 3 et 4, de celui-ci, de veiller à la compatibilité avec le droit de l’Union des protocoles d’accord conclus par le MES» et au point 174 qu’«en vertu de l’article 13, paragraphe 3, de ce traité, le protocole d’accord qui est négocié avec l’État membre demandeur d’un soutien à la stabilité doit être pleinement compatible avec le droit de l’Union».
