Were the Supreme Court a demiurge in Canada's political life and were it to bring about the type of referendum process set out in its opinion and if a substantial majority, let us say, to pick an arbitrary number, 64%, were obtained in answer to a clear question in the context of an absolute majority rule, then, if we read the opinion carefully, it would have to launch a process of constitutional negotiation and amendment that would in the end transform the procedure set out in section 41 into something more formal.
