Mr. Ray Speaker (Lethbridge, Ref) moved: Motion No. 33 That Bill C-76, in Clause 38, be amended by replacing lines 27 to 36, on page 19, with the following: ``direct that any cash contribution under the Canada Health and Social Transfer to that province for a fiscal year be reduced, in respect of each default, by an amount determined by the Federal Court to be appropriate having regard to the gravity of the default pursuant to an application by the Minister, where the Federal Court determines ...[+++]that a default has occurred'.

``under section 20, the Federal Court is of the opinion that the province does not or has ceased to comply with section 19, the Court may, by order, direct that any cash contribution under the Canada Health and Social Transfer to that province for a fiscal year be reduced, in respect of each non-compliance, by an amount that the Court considers to be appropriate, having regard to the gravity of the non-compliance'.
